The following summaries highlight select experience representing a variety of the types of cases the firm has handled.
SEAVIEW ESTATES: $10,000,000
This claim centers around an ancient landslide that was reactivated in 1999 and 2000. Twenty homeowners retained our services to represent them concerning damages resulting from that activity. The homeowners claimed that the City of San Clemente was responsible because one of their water lines separated. Additional defendants included neighboring golf courses, mobile home parks and prior developers. Damages included the total destruction of three of the homes. The matter was resolved through an extremely creative settlement which provided for the defendants to fund almost 10 Million Dollars to pay for costs, attorneys’ fees, and massive repairs at the site. The settlement was contingent upon contractors being able to complete the work within budgets established during the negotiation.
MISSION COURTS II: $4,000,000
This was another large condominium complex located in Rancho Santa Margarita, California that had more than 205 units. The homeowners association contacted our law firm with significant claims about water intrusion through the roofs and windows. Through our investigation, we also found deficiencies with concrete, drainage, and structural items. Our team of experts presented reasonable and efficient methodologies which eventually resulted in a settlement of approximately $4 Million Dollars.
OLYMPIC CREST: Confidential
This was a large claim involving 99 single family homes located in Santa Clarita, California. Due to the fact that the claim centered solely on stucco related failures, the homeowners took the unusual steps of attempting to have the claim classified as a Class Action. Unfortunately, the Court denied the Class but all 99 families continued to prosecute their claim. After approximately two years, the homeowners were rewarded with a significant settlement, which terms and conditions are required to remain confidential.
400 THIRD AVENUE HOMEOWNERS ASSOCIATION: $7,000,000
Our firm was contacted by the Board of Directors for the 400 Third Avenue condominium high rise. This structure was 17 stories high and contained more than 800 condominium units. This project was advertised and sold as a very high-end residential condominium building with sales prices up to $5 million. The homeowners’ initial complaints largely had to do with water intrusion around the windows, roof and numerous problems with the heating and air conditioning systems. The case was resolved in just 18 months and resulted in the Association having all construction deficiencies addressed, all costs of temporary repairs reimbursed, all expert fees being paid and the attorneys’ fees being paid. This repair-bases settlement had a value in excess of $7 Million Dollars.
MONACO HOME OWNERS ASSOCIATION: Confidential
This project consists of 408 condominium units located in Anaheim Hills, California. The multi-million dollar construction defect claim centered around water intrusion through roofs, windows, decks and also involved claim concerning concrete and structural connections. While a large project, litigation moved quickly and was resolved in approximately two years. The terms and conditions of the settlement are required to remain confidential, however, the homeowners were very pleased with the outcome.
